She is currently embroiled in a legal spat with her former partner Gabriel Aubry over their four-year-old daughter Nahla.

But while Halle Berry is reportedly attempting to win permission to move the youngster to her fiancé Olivier Martinez's native France, the group have been putting on a touching display during the Easter break.

The actress and her loved ones took to Malibu where they frolicked on the beach.

The 45-year-old appeared to be in utter bliss as she enjoyed the fresh ocean air and having her two favourite people around her.

The busy star took time out from the time consuming school runs she is often seen on to play in the sand with her child.

Wearing a pink bikini underneath a loose white T-shirt and denim shorts, the pixie-haired movie star looked effortlessly good.

Her little girl was dressed in a pretty multi-coloured striped dress but despite her delicate look, she clearly has a tomboy personality.

Nahla was enthusiastic about discovering the nature around her, running up and down the shore to collect decayed palm leaves and large rocks.

And she appeared to be getting along brilliantly with her future step-father, swinging on makeshift apparatus under the Frenchman’s guidance.

The two even had some alone time as he took the little girl for a small dip in the water while her mother captured the moment on camera.

According to TMZ.com, Berry's legal council hope to prove that Gabriel’s modelling schedule would mean he has plenty of free time to travel back and forth from the US to Europe to visit his child.

However Gabriel is vigorously opposing the proposed move, which must be approved by the custody judge.

'Of course it's true'! Olivier Martinez confirms his engagement to Halle Berry

Happy couple: Olivier Martinez smiled broadly as he confirms he has gotten engaged to Halle Berry who has been sporting an emerald ring on her finger for several weeks

There had been rumours over the past few weeks that Halle Berry and Olivier Martinez had gotten engaged after she was seen wearing an emerald ring.

But now the French actor has confirmed that they are indeed planning to tie the knot.

Martinez was at the opening of his new restaurant Villa Azur in South Beach last night when he spoke of the happy news.

It's official: The couple's relationship has steadily grown over the past few months

'Yes, of course it's true,' the 46-year-old told The Miami Herald proudly.

But Martinez also wanted to dispel a report from a jeweller who had been bragging he had designed the ring for the bride-to-be.

'There is a jeweller taking credit for doing the ring and it's a lie,' he said. 'They have nothing to do with this.'

The sparkler was actually designed by Robert Mazlo who is a Parisian jeweller based in Saint-Germain-de-Pres.

Martinez said he was a 'real artist' who made jeweller for 'kings and queens for many centuries.'

This will be Halle's third marriage after failed relationships with former baseball star David Justice and soul singer Eric Benét.

She has a three-year-old daughter, Nahla, with Canadian model Gabriel Aubry although the pair are currently embroiled in a bitter custody dispute. Olivier has grown very close to the little girl and they have often been seen playing together and being affectionate towards each other.

Meanwhile, Olivier has dated a long list of actresses and models including Mira Sorvino, Kylie Minogue and Rosie Huntington-Whiteley.

The pair met while filming their new movie Dark Tide in South Africa in 2010.

Halle's ex Gabriel Aubry has allegedly filed legal documents that might require her to pay through the nose for his lifestyle.

He is said to have asked for $15,000 - $20,000 a month so that he can provide a proper home for his little girl.

According to TMZ.com, he has also asked for a 'very large' clothing allowance amount for his daughter, as well as additional funds to take her to Canada to visit his family. The website reports that she is fighting Aubry on his request.

A hearing was originally scheduled for last week, but has been put off until April 9.

A dependency judge still has to decide whether or not some of Aubry's custody rights will be taken away.

Halle is said to be pushing to have the right to take Nahla to France where she wants to set up a home there with Olivier.

He might not be her biological father but it’s quite clear that Nahla and Olivier Martinez have a very special bond as Nahla affectionately kissed her mother's beau.

The 46-year-old French actor showed off his paternal side as he watched the three-year-old playing.

Nahla clearly enjoyed having an audience and showed off her skills on a rope swing during a day at the beach.

The touching scenes came amid the ugly custody battle raging between Halle and her ex Gabriel Aubry.


Reports surfaced yesterday that Aubry has 'agreed to take anger management classes' following an incident where he is alleged to have 'pushed' his daughter's nanny.

And the US website also report that the LA County Department of Children and Family Services have recommended counselling for Nahla.

According to TMZ, the 36-year-old male model and his former girlfriend spent hours yesterday with representatives from the Los Angeles County Department of Children and Family Services.

It is claimed by sources that social workers concluded Aubry 'needed to work on his anger issues.'

TMZ claim that the DCFS recommended Aubry take anger management classes and sources say he 'agreed to enrol.'

A law enforcement source connected with the case told the website: 'Gabriel has a little bit of a temper, but the good news is that he realises it.'

The recommendation stems from an incident earlier this month in which Gabriel allegedly pushed the nanny while she was holding three-year-old Nahla.

Halle was advised to seek professional help after the nanny claimed Gabriel screams at the child and violently yanked Nahla from her arms.

In turn, Gabriel is asking for a restraining order as he believes she's inventing lies to side with Halle.

The couple are due in court today.

As well as spending time as a pair Olivier and Nahla made their way back to where Halle was sat.

The actress, who broke her foot last September, was sat watching her boyfriend and her daughter bonding.

The actress was dressed in a grey top with bright green Zebra's printed on the front and had her jeans rolled up.

It appeared like it wasn't just Halle who was displaying war wounds - Nahla was also sporting a plaster on her right knee.

Olivier, Halle and Nahla looked like a happy family as they made the most of the nice weather sat on the beach.

The little girl at one point appeared to be using Halle as a climbing frame and was crawling on her back.

Nahla also enjoyed sitting in her mother's lap as Halle attended to her little girl's hair.

Halle's cast may be a continued pain in the leg for the 45-year-old actress, but for her daughter Nahla it has clearly provided hours of entertainment.

The Oscar winning star hobbled into a West Hollywood French restaurant for lunch this morning, displaying some colourful art work on her cast.

It also had the three-year-old's name emblazoned on the top of the plaster in purple pen.

She hobbled along using a pair of white crutches, while her rumoured fiancé Olivier Martinez carried her daughter into the restaurant.

Halle broke her foot while filming movie Cloud Atlas in Spain last September, but the break in her left foot recently reoccurred, leaving her in the plaster cast and crutches.

Will it be third time lucky? 'Halle Berry engaged to marry Olivier Martinez'

He's a keeper! Olivier Martinez and Halle Berry seen in April: The actors are engaged to be married


She's had a rough ride in the romance stakes. But Halle Berry has not given up on finding her Prince Charming as it appears the 45-year-old actress and French actor Olivier Martinez are engaged to be married.

A source has confirmed the happy news to Us Weekly magazine and Halle, who despite her two previous marital failures has said 'he's a keeper.'

Martinez, 46, reportedly proposed with an emerald-and-diamond ring from Gurhan which the Catwoman actress has been seen sporting recently.


The actress was first pictured with a ring on her wedding finger as early as December 29, leading to speculation that Martinez planned a Christmas proposal.

She has been careful to keep the ring turned around to just look like a plain band in recent weeks, but gave photographers a glimpse of the stunning stone during an outing in LA yesterday.

The attractive couple first met while working opposite one another on the film Dark Tide; they soon emerged as a hot new couple in the autumn of 2010.

A source told Us: '[Halle] had given up on being married, but she trusts Olivier. He makes her feel safe. He's a keeper.'

Martinez previously dated Australian pop princess Kylie Minogue, 43, for several years - and supported her through her battle with breast cancer - before they split in 2007.

For Berry, who has a 3-year-old daughter, Nahla, with ex-boyfriend Gabriel Aubry, this will mark her third trip up the aisle.

She dated handsome model Aubry, 36, for almost five years before their acrimonius split in April 2010.

Halle's love life has been fraught with hard times. An ex-boyfriend beat her so badly that she was left partially deaf, her first marriage falling apart caused her to attempt suicide and she accused her second husband of being a sex addict.

And before that Halle wed former baseball player David Justice in 1993, divorcing four years later. The actress has spoken publicly about attempting suicide after the end of her first marriage.


She then married R&B singer Eric Benet in 2001, only to separate in 2003 and finalise their divorce in 2005.
